A Study on Improvement in the Civil Service¡¯s Accident Compensation

Abstract

|
The study aims to examine the present situations and problems of the Civil Service¡¯s Accident Compensation(CSAC), suggesting rational alternatives to improve the system. The main findings are as follows: First, with regard to coverage in the CSAC, the legal scope of civil servants does not correspond to coverage in the Civil Service¡¯s Pension law. Second, the death on public duty in the CSAC are divided into the death on duty and the death on dangerous duty on the basis of the degree of danger, thus differentiating the level of compensation and causing unfairness between civil servants. Third, while the individual benefits under the CSAC tend to be low, shortage of coordination in relation to double benefits can cause over-compensation for the civil servants. Fourth, comparing between the CSAC and occupational injury compensation, the former is more unfair and irrational in the benefit structure and level. On the basis of those findings, the paper suggests that the CSAC should augment the long-term livelihood protection for the civil servants and improve benefit system for fairness.
